Terms of service

Last updated [date]

These terms apply to the Enoki website, dashboard and app. By registering or using Enoki on behalf of a business, you agree to them for yourself and for that business.

1. About Enoki

Enoki is provided by [company legal name] (registration number [number]), of [registered address]. Enoki is a marketplace and stock system that connects hospitality businesses ("buyers") with their suppliers. Contact us at service@enoki.co.za.

2. Who can use Enoki

Enoki is for businesses. You must be at least 18 and authorised to act for the business you register or join. We review business registrations and may approve or decline them.

3. Your account

Keep your login details private and tell us straight away if you think someone else has used your account. The owners and administrators of a business decide who joins it and what each member may do, and the business is responsible for what its members do in Enoki.

4. How ordering works

A buyer sees a supplier's prices and can order once the supplier has approved their relationship. Suppliers set their own catalogues, prices, minimum order values and delivery terms, and each order is a contract between the buyer and the supplier, not with Enoki.

An order is placed when the buyer submits it and is confirmed when the supplier accepts it. Suppliers may decline an order. The price, tax and currency shown at checkout are recorded on the order. Enoki does not take payment, deliver goods or guarantee them; payment and delivery are arranged between buyer and supplier.

5. Supplier obligations

Suppliers must keep their catalogues, prices, tax settings and stock information accurate, deal fairly with the orders they accept, and comply with the laws that apply to the goods they sell.

6. Fees

[Fees, billing and payment terms, if any.]

7. Your content

Your business keeps ownership of the information and images it adds to Enoki. You give us permission to store, process and display that content as needed to run the service for you and the businesses you trade with. You must have the right to share everything you upload.

8. Acceptable use

You may not:

  • use Enoki for anything unlawful, misleading or fraudulent;
  • try to reach another business's information, or get around security or usage limits;
  • upload malicious code or content that infringes someone else's rights; or
  • overload, scrape or resell the service.

9. Integrations and connected apps

Optional features such as WhatsApp ordering, supplier system integrations and connected apps depend on third-party services, which have their own terms. You choose what to connect and can remove connections at any time.

10. Availability, suspension and closing accounts

We work to keep Enoki available but cannot promise it will always be uninterrupted or error-free. We may suspend or close an account that breaks these terms or puts the service or other users at risk. You can delete your account at any time from Account in the dashboard or app, or ask us to close it.

11. Liability

To the extent the law allows, Enoki is not liable for the goods, prices or conduct of buyers and suppliers, or for indirect or consequential loss. Nothing in these terms limits rights you have under the Consumer Protection Act or other law that cannot be excluded.

12. Privacy

Our privacy policy at enoki.co.za/privacy explains how we handle personal information.

13. Governing law

These terms are governed by the laws of South Africa.

14. Changes to these terms

We may update these terms. We will change the date at the top and tell account holders by email about significant changes. Continuing to use Enoki after a change means you accept the updated terms.
